Platform Terms of Service
1. ACCEPTANCE OF TERMS
By accessing the NGN Network (nextgennoise.com), you agree to be bound by these Terms of Service. If you do not agree, disconnect immediately.
2. SOVEREIGN IDENTITY
Users are responsible for maintaining the security of their node access. NGN is a decentralized-first infrastructure; we cannot recover 'lost' cryptographic keys or credentials managed outside our primary vault.
3. CONTENT SOVEREIGNTY
Artists and Station Operators maintain 100% ownership of their signals. NGN provides technical distribution and ledger-based attribution. You grant NGN a non-exclusive, worldwide license to distribute your content across the NGN Fleet nodes.
4. PROHIBITED CONDUCT
You shall not use the NGN Network to:
- Distribute malware or malicious signals.
- Infringe upon the intellectual property of others without a direct contract.
- Attempt to bypass the Sentinel defense layer or manipulate the Network Ledger.
5. THE 90/10 MANDATE
All commercial transactions on NGN adhere to the 90/10 Mandate: 90% of gross revenue is distributed to the content creators (Artists/Labels), and 10% is retained for Network maintenance and infrastructure.
6. LIMITATION OF LIABILITY
NGN is provided 'AS IS'. We are not liable for signal interruptions, data loss, or indirect damages arising from the use of the Sovereign Rig.

Sovereign Privacy Policy
1. PRIVACY-FIRST MANDATE
NGN is built on the principle of 'Sovereign Privacy'. We do not sell user data to third-party brokers. We do not use Meta or Google tracking pixels.
2. DATA COLLECTION
We collect only what is necessary to maintain the integrity of the Network Ledger:
- Node Identity (Email/Username)
- Technical Telemetry (IP Address for fraud prevention)
- Interaction Shards (Listen events, click-throughs)
3. THE SOVEREIGN SHIELD
All attribution is handled internally via the Sovereign Shield. We use localized, zero-knowledge proofs to verify engagement without exposing individual user identities to advertisers.
4. USER RIGHTS
You have the right to purge your Node Identity at any time. Due to the immutable nature of the Network Ledger, historical playback events remain as anonymized transaction shards.

Sentinel DMCA Policy
1. COPYRIGHT INTEGRITY
NGN respects the intellectual property of creators. We operate under the 'Direct Contract First' protocol.
2. TAKEDOWN PROCEDURE
To report copyright infringement, send a formal 'Takedown Signal' to legal@nextgennoise.com including:
- Identification of the infringed work.
- Identification of the infringing signal on the NGN Network.
- Your contact information and a statement of good faith.
3. REPEAT OFFENDERS
Nodes that repeatedly transmit infringing signals will be permanently blacklisted from the NGN Fleet and their access keys revoked.

Artist Distribution Terms
1. DISTRIBUTION SOVEREIGNTY
By uploading content to NGN, you authorize the platform to distribute your audio shards across all Fleet nodes, including partner stations and PWAs.
2. ROYALTY LEDGER
Earnings are tracked in real-time on the NGN Royalty Ledger. Distributions occur when your balance exceeds the $25 'Minimum Payout Shard'.
3. INDEPENDENCE
Artists maintain 100% of their copyrights. NGN is a non-exclusive distribution partner. You are free to distribute your music on other platforms simultaneously.

Advertiser Command Terms
1. DEMAND GENERATION
Advertisers (Demand Generators) agree to provide high-fidelity creative assets (shards) that adhere to the NGN Aesthetic Standards.
2. HUMAN ENGAGEMENT GUARANTEE
NGN guarantees that all billed impressions are verified by the Sentinel defense layer as 'Human-Driven'. Bot traffic is automatically filtered and credited back to the Advertiser's balance.
3. THE 90/10 DISTRIBUTION
Advertisers acknowledge that 90% of their spend is distributed directly to the Artists and Station Operators whose signals they occupy.
4. CANCELLATION
Campaigns can be paused or terminated in real-time via the Goliath Ad Terminal. Remaining balances are refundable minus a 3% processing shard.

Station BYOS Protocol
1. DIRECT RIGHTS MANDATE
The Bring-Your-Own-Sound (BYOS) protocol requires the Station Operator to have direct, written contracts with all artists or labels played on their station.
2. NO PRO INTERFERENCE
BYOS stations operate outside the traditional PRO (ASCAP/BMI/SESAC) system. You MUST NOT play content covered by blanket licenses unless you also have a direct waiver or contract.
3. INDEMNITY
The Station Operator fully indemnifies NGN and Graylight Creative against any copyright claims arising from their station's signal. NGN provides the technical 'pipe' only.
